Fideicomisos

The vast majority of foreigners (non-Mexican citizens) who have bought land in fideicomiso have no idea what the document says.  Even though it controls all aspects of their Mexican lands, none of their representatives ever explained it to them.  The clients were “funneled” through the purchase process, they signed the document and paid hundreds of thousands of dollars, and do not know what they signed.  Instead, they simply did what they were told to do by the people putting the closing together.  They didn’t even ask questions.

Many foreign buyers pay the full purchase price and sign the closing documents without having any idea what they are signing or whether the information contained in the document is correct. They would never do this in their home country, yet they let themselves be railroaded through the closing process in Mexico.  You are the one with the money.  You determine how this process should go. Don’t “check your brains at the border”.

You also need to consider how your assets will be passed to your heirs upon your death. At CancunLaw, we have extensive experience in international estate planning.
